1. Acceptance of Terms

Welcome to Quby ("App"), a mobile application provided by Damir Rama ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Quby is a free mobile application that allows users to:

• Scan QR codes using their device camera
• Generate QR codes for various data types (text, URLs, SMS, email, phone numbers, WhatsApp messages)
• View and manage a local history of scanned and generated QR codes
• Customize app settings (theme, haptic feedback, auto-save)
• Submit feedback to help improve the App

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device solely for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any commercial purpose without our prior written consent
• Transfer, sublicense, or assign your rights to use the App to any third party

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App to create or scan QR codes containing illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable content
• Create QR codes that link to malware, viruses, phishing sites, or other malicious content
• Use the App in any way that could damage, disable, overburden, or impair our servers or networks
• Attempt to gain unauthorized access to any part of the App, other users' data, or our systems
• Use the App to violate any applicable local, state, national, or international law
• Use the App to infringe upon the intellectual property rights of others
• Collect or harvest any information from the App using automated means (bots, scrapers, etc.)

5. Intellectual Property Rights

The App, including all content, features, functionality, software, user interface, and design, is owned by Damir Rama and is protected by Swiss and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Your Content: You retain all rights to the QR codes you create using the App and the data you choose to encode in them. However, by submitting feedback through the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and incorporate your feedback into the App without attribution or compensation.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the App will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy, reliability, or completeness of QR codes scanned or generated
• Warranties that defects will be corrected or that the App is free of viruses or harmful components

QR Code Accuracy: While we strive to provide accurate QR code scanning and generation, we do not guarantee that all QR codes will be correctly decoded or that generated QR codes will be compatible with all QR code readers. You are responsible for verifying the accuracy of scanned data before taking action.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DAMIR RAMA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, use, goodwill, or other intangible losses
• Damages resulting from your use or inability to use the App
• Damages resulting from any QR codes scanned or generated using the App
• Unauthorized access to or alteration of your transmissions or data
• Any conduct or content of any third party on or accessed through the App

Our total liability to you for all claims arising out of or related to these Terms or your use of the App shall not exceed the amount you paid to use the App (which is zero, as the App is free).

Important Notice for Users: You are solely responsible for the content of QR codes you scan or create. Scanning unknown QR codes may expose you to malicious websites, phishing attempts, or other security risks. Exercise caution and verify sources before scanning.

8. Indemnification

You agree to indemnify, defend, and hold harmless Damir Rama from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Content you create, scan, or distribute using the App

9. Third-Party Services and Links

The App may contain links to third-party websites, services, or resources that are not owned or controlled by us. When you scan QR codes, you may be directed to third-party websites or services.

We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that we shall not be liable for any damage or loss caused by or in connection with your use of any third-party content or services.

Third-Party Backend Services: The App uses Supabase for feedback storage, Sentry for crash reporting, and PostHog for analytics. Your use of the App is also subject to these services' terms and conditions. See our Privacy Policy for more information.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the data practices described in our Privacy Policy.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated these Terms.

You may stop using the App at any time by uninstalling it from your device. The following sections shall survive termination: Intellectual Property Rights, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

12. Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and without liability to you. We may also update the App to add new features, fix bugs, or improve performance.

13. Changes to Terms

We may revise these Terms from time to time. When we make significant changes, we will notify you by:

• Updating the "Last Updated" date at the top of these Terms
• Providing notice through the App or app store update notes

Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions. For users in the European Union, we also respect applicable EU consumer protection laws and regulations.

Any disputes arising out of or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Switzerland, unless otherwise required by mandatory consumer protection laws.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Damir Rama regarding the App and supersede any prior agreements or understandings.

17. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

18. Age Restrictions

The App is rated for users aged 4 and above. While we do not knowingly collect personal information from users, parents and guardians should supervise children's use of the App and ensure they do not scan unknown or potentially harmful QR codes.

19. No Guarantees of Availability

While we strive to maintain App availability, we do not guarantee uninterrupted access. The App may be unavailable due to maintenance, updates, technical issues, or third-party service disruptions (e.g., Supabase, Sentry, or PostHog outages).

20. Feedback and Suggestions

We welcome your feedback and suggestions about the App. By submitting feedback through the App's feedback feature, you acknowledge that:

• Your feedback is voluntary and provided without expectation of compensation
• We may use your feedback to improve the App without attribution or payment
• Feedback is submitted anonymously, and we cannot respond to individual submissions

21. Export Control

The App may be subject to export control laws. You agree not to export or re-export the App in violation of any applicable laws or regulations.
